Texas Data Privacy and Security Act (TDPSA)

A new framework, the Texas Data Privacy and Security Act (TDPSA), seeks to establish policies for businesses that capture, process, or store Texas residents' personal information. The act stresses safeguarding sensitive data, transparency, and responsible data governance.

TDPSA helps organizational protection of individuals’ personal information, but also reduces exposure to breaches and misuse. Non-compliance may result in enforcement actions, fines, and tarnishing a business. Good privacy and security procedures are fundamental to trust, regulatory compliance, and operational resilience.

These are critical responsibilities, among others, around security of personal data, limiting the use of collected information to its intended purpose, clear communication to people, and handling requests for access or deletion of the data. Businesses, too, are supposed to have governance frameworks and documents that show they’re compliant.

TDPSA compliance reviews have usually emphasized visibility to sensitive data, stronger security controls, and uniformity on what is in place for the policies and how privacy should be enforced across systems, users, and processes.
